Owsley Will Contests

Circuit Court matters enter the probate search when a probate dispute becomes contested. The Kentucky Circuit Court overview lists contested probate among Circuit Court jurisdiction. The Owsley County Clerk research also states that a person aggrieved by District Court action admitting or rejecting a will may bring an original action in Circuit Court in the same county to contest that action.

The will contest notice details matter. The action must be brought within two years after the District Court decision. The notice must state the testator name, style of action, court where filed, nature of action, and commencement date. The notice must be signed by the plaintiff or attorney and does not need acknowledgment or notarization. Court copies and contested filings should be requested through the Circuit Court Clerk rather than eCCLIX.
